Please read these Terms and Conditions carefully before making a reservation through this website. By completing a booking, you confirm that you have read, understood, and agree to be bound by these Terms.

1. About Book Atitlan LLC

Book Atitlan LLC (“Book Atitlan,” “we,” “us,” or “our”) is a limited liability company registered in the State of Wyoming, United States. We operate bookatitlan.com as an authorized booking agent and reservation management platform for the following independently operated hospitality property located at Lake Atitlan, Guatemala:

• Casa Kula — boutique hotel and food & beverage operations

Book Atitlan LLC acts solely as a booking intermediary. By making a reservation through this website, you are entering into a direct service agreement with the applicable property. Book Atitlan LLC is not the operator, owner, or manager of any physical hospitality facility.

2. Scope of Services

The services provided by Book Atitlan LLC are strictly limited to:

• Online marketing and listing of available accommodations and retreat programs

• Processing reservation requests submitted through this website

• Collecting payment on behalf of the property at the time of booking

• Communicating booking confirmations and relevant property information to guests

Book Atitlan LLC does not provide, facilitate, promote, or accept payment for any of the following:

• Therapeutic, medical, or clinical services of any kind

• Substance-assisted, psychedelic, or plant medicine programs

• Any activity that is illegal under Guatemalan law, United States law, or international law

• Any service not explicitly listed and bookable on this website

All programs and services available for booking through this platform are lawful, independently operated, and consistent with applicable hospitality and wellness regulations.

3. Booking Agent Status — Not a Money Services Business

Book Atitlan LLC collects payment at the time of reservation in its capacity as an authorized booking agent acting on behalf of the property. This collection of funds is incidental to the reservation transaction and does not constitute money transmission, currency exchange, or any money services business (MSB) activity under applicable U.S. federal or state law.

Book Atitlan LLC is not registered as a money services business with FinCEN and does not operate as one. All payments processed through this website are for the sole purpose of securing hospitality reservations.

4. Reservations & Payments

4.1 Booking Confirmation

A reservation is confirmed only upon receipt of full or partial payment as specified at checkout and issuance of a written confirmation by Book Atitlan LLC. Verbal or informal requests do not constitute a confirmed booking.

4.2 Payment Processing

All payments are processed securely through Stripe, Inc., a third-party payment processor. By completing a transaction on this website, you also agree to Stripe’s Terms of Service and Privacy Policy. Book Atitlan LLC does not store, retain, or have access to your full credit card or payment card details. All payment data is encrypted and handled exclusively by Stripe in accordance with PCI-DSS standards.

4.3 Pricing & Currency

All prices listed on this website are in US Dollars (USD) unless otherwise stated. Book Atitlan LLC does not exchange currency and is not responsible for exchange rate fluctuations that may appear on your card statement.

4.4 Service Fee

Booking prices displayed on this website include an intercompany service fee retained by Book Atitlan LLC for reservation management services. This fee is non-negotiable and non-refundable except as provided in our Cancellation Policy below.

5. Cancellation & Refund Policy

Cancellation and refund terms are set by the operating property and will be clearly disclosed at the time of booking. General terms are as follows:

• Cancellations made more than 30 days prior to arrival: full refund less the service fee

• Cancellations made 15–30 days prior to arrival: 50% refund of the accommodation amount

• Cancellations made fewer than 15 days prior to arrival: no refund

Refunds are processed by Book Atitlan LLC as directed by the applicable property. Book Atitlan LLC does not exercise independent discretion over refund decisions. Refunds will be issued to the original payment method within 7–10 business days of approval.

Retreat program cancellation terms may differ from accommodation cancellation terms and will be disclosed separately at checkout.

6. Third-Party Facilitators

Certain programs or events at Casa Kula and CobAnanda may be operated by independent third-party facilitators who rent the property space. In such cases:

• The third-party facilitator is solely responsible for the content, conduct, and legality of their programs

• Book Atitlan LLC does not endorse, vet, or assume liability for third-party facilitated programs not listed on this website

• Guests booking third-party facilitated programs do so directly with the facilitator and under any terms the facilitator provides

• Book Atitlan LLC does not process payments for third-party facilitated programs not listed on bookatitlan.com

If you are uncertain whether a program is operated by Book Atitlan LLC or a third-party facilitator, please contact us before booking.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Book Atitlan LLC shall not be liable for:

• Any act, omission, or negligence of the operating property or its staff

• Personal injury, loss, or damage sustained at the property

• Any programs, services, or activities conducted by third-party facilitators at the property

• Force majeure events including but not limited to natural disasters, government restrictions, or property closures

Our total liability to you in connection with any booking shall not exceed the total amount paid by you for that reservation.

8. Governing Law

These Terms and Conditions are governed by the laws of the State of Wyoming, United States. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Sheridan County, Wyoming.
